All Ohio Physicians Have a Green Light to Recommend Medical Marijuana

The Pharmacy board has delayed the opening of the Ohio Medical Marijuana Patient Registry due to the delays in cultivation. Opening the patient registry would have exposed patients legally. It would have cut short the time period of the limited legal protection in Section 6 of HB523 for those who have a recommendation; while there was still no adequate legal supplies.
The purpose of section 6 was to serve as a bridge to the future and provide some legal rights to patients. Note that right was taken away by the Ohio Legislature in 1997’s Senate Bill 2.
But, the state administrators, in particular the Medical Board and the Pharmacy Board must stop answering physicians with misleading information. That only serves to instill doubt and fear into Doctor’s offices about making a recommendation to a qualified patients.
All Ohio MD & DO Doctors are protected by law (Ohio Revised Code 4731.30 Section H), whether or not they have the certification or not! Furthermore The Medical Board of Ohio has recognized the fundamental truth about Ohio Physicians' freedom to make recommendations for medical marijuana soon after the law was effective. Below is a direct quote from the Medical Board policy decision at their 10/19/2016 meeting….
"The Medical Board is in no way prohibiting the recommendation of medical marijuana now that HB523 is effective.”
Ohio Patient Network strongly encourages all patients who qualify to talk to their own physician to obtain a recommendation. Having a recommendation now will fast track a patient to obtain a “State Certified Recommendation”. Thus when the dispensaries are fully stocked and open patients will be able to obtain a legal supply of medical marijuana.

Washington, D.C. — Today, after months of debate and continuing resolutions, the House of Representatives passed its Appropriations package for the fiscal year of 2018. Unlike previous short term measures, this bill will fully fund the government through September 30, 2018. At over 2,200 pages the bill is a massive combination of funding outlays and policy. Due to the hard work of advocates the bill includes the text of the Rohrabacher-Blumenauer amendment.

OPN stepped up legally to protect the MMJ program from being frozen
Ohio Patient Network was contacted by the lawyers representing the State of Ohio; to oppose the challenge to the Medical Marijuana Control Program by the failed cultivation applicants. The failed applicant were seeking to freeze the program till all the cultivation scoring mechanism questions are resolved. OPN, via our lawyer, officially intervened in the case for OPN and worked with the patients and state's lawyers.
We asked Ohio MMJ patients to testify at the two court hearings in Columbus on the impact freezing the program would have on them. OPN was very pleased with response and the testimony and various affidavits we were able to introduce into the court case.
While we fully understand the frustration of the cultivators with the Department of Commerce handling of the application and scoring, we could not let the program be frozen. OPN appreciates the patients for stepping out and speaking up! The judges in the two separate cases have rules that the program will not be halted

Ohio Medical Board accepting Physicians applications for Medical Marijuana Certificates
Per an announcemnt by the State Medical Board of Ohio, The Medical Board is now accepting applications for a certificate to recommend (CTR) under the Ohio Medical Marijuana Control Program. MDs and DOs with a full, unrestricted Ohio license are eligible to apply. The full requirements are outlined in HB523 and medical board rules OAC 4731-32.
Physicians must complete an OSMA-approved or OOA-approved, 2-hour CME course on the subject. There is NO fee for the certificate to recommend.
The typical course will cover the following subjects
- History of cannabis as medicine
- The endocannabinoid system
- Endocannabinoid Physiology
- Basic cannabis ethnobotany
- Cannabis pharmacology
- Clinical case study reviews, indications and practice
- Delivery and dosage
